1. Scope and Acceptance

These Terms of Service ("Terms") govern your access to and use of the website felyra.studio (the "Site"), your Felyra account, and your purchase, download, and use of our digital products and subscriptions (including Felyra Pro).

By accessing or using the Site, creating an account, purchasing digital products, or subscribing to Felyra Pro, you agree to be bound by these Terms. If you do not agree, you must not use the Site or the services.

2. Who Operates Felyra

The Site is currently operated by Rares Muresan as an individual, under the trade name "Felyra", based in Cluj-Napoca, Romania.

In the future, operation may be transferred to a dedicated company (for example, FELYRA STUDIO S.R.L.). When that happens, these Terms and the legal pages (Legal Notice, Privacy Policy) will be updated with full company details.

This Site is currently focused on Felyra’s own digital products. If third-party creators are added in the future, additional terms may apply to their listings and licenses, which will be clearly indicated.

3. Eligibility and Account

To use Felyra and purchase digital products, you must:

• Be at least the minimum age required by law in your country to enter into online contracts (typically 16+ in the EU).
• Provide accurate and complete information when creating your account.
• Keep your login credentials confidential and secure.

You are responsible for all activity that occurs under your account. If you suspect unauthorized access, you must notify us as soon as possible.

We may suspend or terminate accounts that are misused, used to violate these Terms or applicable law, or compromise the security of the service.

4. Digital-Only Service and Availability

Felyra offers digital products only (for example, templates, code, UI kits, design assets), with no physical shipping. After a successful payment, access to your digital items is usually available instantly, via your account.

We aim to keep the Site available at all times but do not guarantee uninterrupted or error-free operation. Planned maintenance, technical issues, or force majeure events may cause temporary interruptions.

5. Pricing, Currency, and Payments

All prices on Felyra are displayed and charged in EUR (€). We may update prices, run promotions, or change product availability at any time before you complete checkout.

Payments are processed securely via Stripe using cards or supported wallets (for example, Apple Pay or Google Pay). By placing an order, you authorize us and our payment processor to charge your selected payment method for the full order amount, including any applicable taxes if required by law.

Felyra does not store your full card number or CVC/CVV on its own servers. We may store non-sensitive details such as the payment method (card / Apple Pay / Google Pay), card brand, and last 4 digits of the card number for your account history and receipts. 6. Digital Delivery, Downloads, and Rate-Limits

Once payment is confirmed, digital products you purchase are attached to your account and made available for download.

• Downloads are tied to your Felyra account; an account is required to access purchased files.
• You generally have unlimited downloads for purchased products, subject to fair-use policies.
• For security and anti-abuse reasons, downloads are rate-limited (for example, up to 5 downloads per minute per session).

We reserve the right to adjust rate-limits and protective measures to prevent abuse (for example, automated scraping or unauthorized sharing).

7. Right of Withdrawal and Refunds for Digital Goods

Under EU consumer law, digital content delivered immediately and not supplied on a tangible medium may be exempt from the standard 14-day withdrawal (cooling-off) period once digital delivery has started with your prior consent.

By completing a purchase and starting the download of a digital product on Felyra, you:

• Expressly request immediate access to the digital content.
• Acknowledge that once the download is available, you lose your statutory right of withdrawal for that purchase.

For this reason, all sales of digital products are final and non-refundable once the item is available for download, except where a refund is required by mandatory law (for example, in case of non-performance or defective products that we cannot remedy).

If you experience technical issues accessing your files, please contact us so that we can help you restore access. In such cases, our primary remedy is to restore or provide access to the product.

8. Felyra Pro Subscription

Felyra Pro is a subscription-based service that unlocks additional features, tools, or products on Felyra. Subscription options may include monthly and annual plans, billed in EUR via Stripe.

• By subscribing to Felyra Pro, you authorize recurring charges to your selected payment method at the chosen interval (monthly or annually).
• You can cancel your subscription at any time from your account settings or by contacting us in advance of the renewal date.
• Cancellation stops future renewals. If you cancel in the middle of a billing period, you will keep your Felyra Pro benefits until the end of the current paid period, and the subscription will then expire automatically.
• No refunds are provided for partially used billing periods (monthly or annual), except where required by mandatory law.

We may modify the Felyra Pro offering, features, or pricing in the future. Where changes are material and affect ongoing subscriptions, we will provide notice in advance and offer you the option to cancel before the changes take effect.

9. Licenses and Permitted Use of Digital Products

When you purchase a digital product on Felyra, you receive a license to use that product under the specific terms stated on the product page or in the included license file.

Unless otherwise indicated, you may not:

• Resell, redistribute, or share the product files as-is on other marketplaces, platforms, or file-sharing sites.
• Claim the original work as your own or remove required copyright notices.
• Use the products in any way that violates applicable law or third-party rights.

Details about whether a product can be used for personal, commercial, or client projects will be shown on the specific product page.

10. Intellectual Property

All content on the Site, including but not limited to design, layout, text, graphics, logos, UI components, product files, and code snippets, is protected by copyright and other intellectual property laws.

You receive no ownership rights to any digital product or to the Site itself. You only receive the limited rights granted by the applicable license. Any unauthorized use may result in license termination and could lead to legal action.

11. Prohibited Conduct

You agree not to engage in any of the following:

• Sharing your account credentials or allowing others to use your account.
• Attempting to bypass download limits, DRM, or technical protections.
• Scraping, mass-downloading, or reverse-engineering our systems.
• Uploading or distributing malware, harmful code, or illegal content.
• Interfering with the security or proper functioning of the Site.
• Using Felyra for fraudulent activities or to infringe others’ rights.

Violation of these rules may result in suspension or termination of your account and, where appropriate, legal action.

12. Tools and User Content

Felyra offers tools (for example, QR generators, file converters, color palette tools, UI snippets) intended to help you generate or transform content for your projects.

You are solely responsible for how you use the outputs of these tools and for ensuring that your use complies with applicable laws and third-party rights (for example, trademarks, privacy, or content licenses).

We do not provide legal, financial, or professional advice through these tools. For important decisions or deployments, you should consult a qualified professional if needed.

13. Warranties and Disclaimer

The Site, all digital products, and Felyra Pro are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Site will be uninterrupted, secure, or error-free, or that any defects will be corrected promptly.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Felyra (and any future operating company) shall not be liable for:

• Indirect, incidental, special, punitive, or consequential damages.
• Loss of profits, revenue, data, or business opportunities.
• Any issues caused by third-party services (for example, hosting providers, Stripe, or analytics tools).
• Any harm resulting from improper use, customization, or implementation of the digital products.

Nothing in these Terms seeks to exclude or limit any liability that cannot be excluded or limited under mandatory law, such as certain consumer rights.

15. Privacy and Cookies

Your use of the Site is also governed by our Privacy Policy and Cookie Policy. These documents explain how we collect, use, and protect your personal data and how we use cookies and similar technologies.

16. Suspension and Termination

We may suspend or terminate your access to the Site or your account if:

• You seriously or repeatedly violate these Terms or applicable law.
• Your account is used for fraudulent, abusive, or harmful activities.
• We are required to do so by law, regulation, or a competent authority.

If your account is terminated due to a serious breach, you may lose access to your downloads and Felyra Pro benefits, without any right to a refund, except where required by law.

17. Governing Law and Disputes

These Terms are governed by the laws of Romania, together with applicable European Union law.

If you are a consumer residing in the EU, you may have additional rights under your local consumer protection laws. In case of a dispute, we encourage you to contact us first so we can try to resolve the issue amicably.

Unless otherwise required by mandatory consumer law, any disputes shall be submitted to the competent courts in Romania.

18. Changes to These Terms

We may update these Terms from time to time, for example when we introduce new features, update Felyra Pro, or adapt to new legal requirements.

The latest version will always be available on this page, with the "Last updated" date shown below. If changes are material and affect your ongoing use (especially for subscriptions), we will provide reasonable notice, and your continued use of the Site after the changes take effect constitutes acceptance of the updated Terms.
